Applying for a work permit
The work permit is one of the most questionable issues for foreigners.
The work permit is one of the most questionable issues for foreigners, and Susan asks the same question. She says;
“Hi Sadettin Orhan,
I have been working in Turkey for several years. My work permit period will expired at the end of this month. The company applied to renew it. If the company application is not accepted, I want to apply for an independent work permit. During the same period, can I apply for the independent work permit? Best regards. Susan.”
Dear Susan, you can apply for the independent work permit. However, if your company applied for a work permit, you can not apply for the independent work permit during the same period. However, after the conclusion of your company’s work permit application, you can apply for an independent work permit.
[HH] How is a rental agreement drawn up?
The second question is about rental agreements. The question is from Nicole. She asks;
“Dear Orhan,
I would like to ask a few questions about real estate rental agreements. I have an apartment in Turkey (in Alanya). How is a rental agreement drawn up? Is the agreement made in writing? How are the rental payments done in Turkey (weekly or monthly)? Can we edit the agreement in German? Best wishes. Nicole.”
Dear Nicole, in Turkish real estate law, rental agreements are complex issues. However, I will try to give some basic information. Principally, the rental agreement does not have to be in writing or be done formally. But in practice, usually it has to be done in writing. In generally, rental payments are made monthly in Turkey. You can edit the agreement in German.
[HH] Who cannot receive a resident permit?
The last question is about resident permits. Hassan asks;
“Dear Sadettin Orhan;
I am not living in Turkey, but I want to. I did some research about the permit procedure. I wonder, though who cannot be given a resident permit? How many years are residence permits given for? Thank you very much. Hassan.”
Dear Hassan, in Turkey, residence permits are not given for all foreigners. So applications for residence permits by the following persons will be refused;
· Persons coming to practice a profession prohibited to foreigners;
· Persons not in a position to conform to Turkish law, customs, or political conditions;
· Persons clearly unable to secure legally the material support necessary for the duration of their desired stay in Turkey;
· Persons who have entered Turkey illegally;
· Persons whose presence in Turkey is disruptive to the general peace and tranquility.
If you are not within these categories, you can apply for the resident permit. The most long-term resident permit is granted for five years. However, a two-year residence permit is usually given on the first application. After the expiry of the residence permit, it can be renewed four times. Persons who wish to extend this period must apply again proceed to the security authorities within 15 days of the expiration of their residence permit. They may also apply before their residence permits expire. After the fourth, you can not renew your resident permit.
